Educational Objective: The objective of studying subjectProsecutorial Investigation Model is gaining deepened scientific knowledge in the field of investigative procedure. That objective implies the acquisition of knowledgewhich goes beyond the national legislative frameworkas well as that future master criminalists gain knowledge about different models of prosecutorial investigation in comparative criminal procedural law and therefore with the different role of the police in the process of detecting and proving criminal offenses.

Projected Outcome: Gaining general and special competences in the area that refers to the concept and dynamics of the investigative procedure, that is:

  • understandingand correctly determining the role and legal position of the basic criminal procedural subjectswho participate in the investigation process;

  • interpreting different types of investigation;

  • identification of key problems when analyzing the model of prosecutorial investigation;

  • training students to properly understand the prosecutorial investigation model and the relationship between the public prosecutor and the police.

Course Contents/Structure

Theoretical education: General information on the model of the investigation and its impact on the efficiency of criminal proceedings; Judicial investigation model; Prosecutorial investigation model; Police investigation model; General considerations on subjects of prosecutorial investigation; Organization, jurisdiction and powers of the public prosecutor's office; Organization, jurisdiction and powers of the police; Prosecutorial investigation modelin the Republic of Serbia; Prosecutorial investigation model in Germany; Prosecutorial investigation model in Italy; Prosecutorial investigation model in Russia; Police investigation model in England.

Practical training:Critical consideration of existing legislative solutionsin the area of prosecutorial investigation; Interpretation of the case law of domestic ordinary courts and the Constitutional Court of the Republic of Serbia, as well as the European Court of Human Rights.

Teaching Methods: Interactive classes: lectures, exercises, presentations (power point, multimedia), discussions, workshops, essays, analysis of positive law and case law.
