Educational Objective: Introducing students with types, forms and methods of controlling the police and police officers in the rule of law. The main objective is to get students acquainted with external and internal mechanisms for police control. These mechanisms include administrative and judicial control of police functions, legal and political control, as well as control through complaints resolution and control by the general and special ombudsmen, citizen committees and informal control by public opinion.

Projected Outcome: Mastered knowledge of institutions, mechanisms and procedures for police control in the rule of law.

Course Contents/Structure

Police functions in the rule of law. Definition and types of control of the police as part of public administration; Police functions and their oversight; internal control of the police (hierarchical control; formal control (self-regulation); administrative review of the administrative function of the police; internal oversight of the use of police powers; internal oversight of the use of force); (self)supervision as part of police management; internal control of the police by the Internal Control Department; Judicial control of the police (judicial review of administrative police activities in administrative proceedings, judicial review of administrative activities in civil proceedings (indirect control in damage compensation proceedings); judicial control of the police in criminal and misdemeanour proceedings; constitutional control of the police). Political control of the police (control by Government and National Parliament; control conducted by the Ombudsman; control by specialised ombudsmen – Commissioner for Personal Data Protection and Information of Public Importance, Commissioner for Equality Protection. Hybrid (mixed) control of the police through complaints resolution. Non-legal forms of police control (citizen committees, public opinion). Overseeing the exercise of human rights of police officers. Development perspectives of police control.

Theoretical education: lectures, exercises, seminar exercises.

Practical training: case studies.
